New Case Numbers Assigned to Converted Cases

Effective October 17, 2006, converted cases that result in divisional office changes are issued new case numbers.

Known as intra-district transfers, these cases require the reassignment of:

Subsequent pleadings filed after case conversion must be filed:

Three scenarios:

  1. Chapter 13 debtor lives in Eau Claire County. Debtor converts to Chapter 7. Clerk’s office will:
    • open the Chapter 7 case with a new case number
    • reassign the case from Judge Martin to Judge Utschig
    • close the Chapter 13 case upon completion of the Trustee’s final account

    Note: All subsequent pleadings contain the Chapter 7 case number and are filed accordingly.

  2. Chapter 7 debtor lives in Eau Claire County. Debtor converts to Chapter 13. Clerk’s office will:
    • open the Chapter 13 case with a new case number
    • reassign the case from Judge Utschig to Judge Martin
    • promptly close the Chapter 7 case

    Note: All subsequent pleadings contain the Chapter 13 case number and are filed accordingly.

  3. Dane County debtor files a Chapter 13 case. Debtor converts to Chapter 7.
    • Not an intra-district transfer
    • No change in case number
    • No reassignment of judge

Where do you file the pleadings?

Creditors: Keep filing in the original case until you get notice of a conversion with the new case number.
Debtors: After filing your Notice of Conversion, you must wait if it is an intra-district transfer case. If it is, the Clerk’s office opens a new case. If you filed a Motion to Convert with a proposed Order, you will need to wait until the judge signs the order. The Clerk’s office will then open a new case if it is an intra-district transfer.
