Motion to Reopen

HIGHLIGHTS

A motion may be filed in a closed bankruptcy case for the following reasons:

To file amendments to schedules adding creditors
To file a certificate re: financial management course to obtain a discharge
To file an adversary proceeding
To file a motion (An exception would be a motion for contempt unless additional relief is requested)
To administer assets (trustee)

Filing Requirements:

Motion
Filing Fee (Refer to Bankruptcy Court Miscellaneous Fee Schedule for exceptions to filing fee. 28 U.S.C. § 1930)
Notice of Motion or Notice of Hearing - Refer to ECF Procedures Manual
Proof of Service
Proposed Order

File under: Bankruptcy > Motions/Applications > Reopen Chapter xx Case

Note: If you wish to reopen an Adversary Case, then motions to Reopen will need to be filed in the Main Bankruptcy Case and the related Adversary Case. However, there is no need to reopen the Main Bankruptcy Case if the Adversary Case is reopened exclusively to enter default judgment.
