Chapter 13 Filing Requirements

Petitions and schedules can be found on the U.S. Court's website. Form sets can be purchased from an office supply store that sells legal forms.

 
Required Documents Due WITH the petition (minimum filing requirements):
  • Filing Fee; OR
    Form 103A - Application to Pay Filing Fee in Installments (Please review the Methods of Payments on how to pay filing fees in installments)
  • Form 101 - Voluntary Petition for Individuals filing for Bankruptcy - (NOTE: Pro se debtors must include a day time phone number with area code)
  • Mailing Matrix - List of all creditors (do not include account numbers or duplicate creditors)
  • Form 121 - Statement of Social Security Number (NOTE: Must include full social security number; and must use local form to include all non-debtor spouse information, if applicable)
  • Certificate of credit counseling and debt repayment plan OR
    Section 109(h)(3) Certification of Exigent Circumstances; OR
    Section 109(h)(4) Request for Waiver
  • Form 119 - Bankruptcy Petition Preparer's Notice, Declaration, and Signature (if applicable)
  • Form 2800 - Disclosure of Compensation of Bankruptcy Petition Preparer (if applicable)
  • Form 101A - Initial Statement About an Eviction Judgment Against You (if applicable)
  • Form 101B - Statement About Payment of an Eviction Judgment Against You (if applicable)
Documents due with the petition or within 14 days:
  • Form 106Sum - Summary of Assets and Liabilities and Certain Statistical Information
  • Form 106A/B - Schedules A/B
  • Form 106C - Schedule C
  • Form 106D - Schedule D (NOTE: Schedule D must include full recording data: page and document numbers, date and place of recording, or state "unrecorded" - attach separate page if necessary)
  • Form 106E/F - Schedule E/F
  • Form 106G - Schedule G
  • Form 106H - Schedule H
  • Form 106I - Schedule I
  • Form 106J - Schedule J
  • Form 106Dec - Declaration About an Individual Debtor's Schedules
  • Form 107 - Statement of Financial Affairs
  • Form 2030 - Disclosure of Compensation of Attorney for Debtor (if applicable)
  • Form 122C-1 - Statement of Your Current Monthly Income and Calculation of Commitment Period
  • Form 122C-2 - Chapter 13 Calculation of Your Disposable Income (if necessary)
  • Payment Advices Cover Sheet with copies of all payment advices (pay stubs) or other evidence of payment received by the debtor from an employer within 60 days before filing the petition, if any.
  • Chapter 13 Plan - (Local Form)
    • method of payment (payroll deduction)
    • plan arrangement
    • percentage to unsecured creditors​​​​​​​​​​​​​​​​​​​​​
NOTE: The new Chapter 13 Plan form is in a PDF expandable/collapsible format. Documents due 7 days before the date first set for the Section 341 meeting of creditors:
  • Provide to the trustee a copy of the Federal income tax return (or transcript of return) for the most recent tax year ending before filing
Documents due before the discharge is granted:
  • Certificate of Financial Management Course (is due no later than the last payment made by the debtor as required by the plan or the filing of a motion for entry of discharge under §1328(b))
