Certification
Regarding Domestic Support Obligations Pursuant to 11 U.S.C. 1228(a) and 1328(a), a debtor who is required to pay a domestic support obligation must certify, upon completion of plan payments, that all amounts due under any order of a court or administrative agency or under any statute have been paid. Failure to file this certification may result in closing without entry of a discharge. The Certification of Domestic Support Obligations is a new official form (B283). It can be found on the court's website. If the debtor(s) has been required to pay a domestic support obligation during the pendency of the bankruptcy case, the attorney for the debtor will be expected to file a Certification re:Domestic Support Obligations. The Certification should not be filed until plan payments are completed. The court will not grant a discharge if the debtor(s) who have been required to pay a domestic support obligation during the pendency of the bankruptcy case fails to file the Certification of Domestic Support Obligations.
3. Select [Bankruptcy > Miscellaneous] 4. Enter the case number (e.g, xx-xxxxx). 5. Select [Certification re: Domestic Support Obligations] from the event list. 6. Skip the Joint Filing screen. 7. Browse to select the Certification (pdf file). 8. Select Debtor, Joint Debtor, or Both for drop-down list. 9. Verify the final docket text; if correct, click [Next] to submit your document(s). Note: Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case. |
