Certification re: Exigent Circumstances

All individual debtors must file (WITH THE PETITION) Exhibit D - Individual Debtor's Statement of Compliance with Credit Counseling Requirements (Official Form 1, Exhibit D). Exhibit D MUST include one of the following:

1. an attached Certificate of Credit Counseling, or

2. statement that the debtor has received the credit counseling briefing but does not have the certificate, or a
   
   Note: The Certificate is due within 14 days.

3. § 109(h)(3) Certification of Exigent circumstances (Exhibit D may serve as the certification if an explanation of the exigent circumstances is included), or a

4. § 109(h)(4) Request for Exemption from Credit Counseling.

Filing Requirements:

• Exhibit D (if an explanation of the exigent circumstances is included) or a Certification of Exigent Circumstances.

To File the Certification re: Exigent Circumstance Electronically:

1. Log into CM/ECF.

2. Select [Bankruptcy >  Miscellaneous]

3. Enter the case number (e.g, xx-xxxxx).

4. Select [Certification of Exigent Circumstances re: Credit Counseling] from the event list.

5. Skip the Joint Filing screen.

6. Select the party filer.

7. Browse to select the Certification of Exigent Circumstances (pdf file).
   
   Attach Exhibit D if no separate certification is filed.

8. Enter date case was filed.

9. Verify the final docket text; if correct, click [Next] to submit your document(s).
   
   Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
