U.S. Trustee's Office Introduces Updated Chapter 11 Operating Instructions and Operating Requirements and Exhibits On August 15, 2022, the U.S. Trustee’s Office for Region 11 posted updated Chapter 11 Operating Instructions and Operating Requirements (“OIRR”) and exhibits for use in all chapter 11 cases. The updated OIRR apply to all chapter 11 cases filed in the Northern District of Illinois and the Eastern and Western Districts of Wisconsin. The Judicial Conference Committee on Rules of Practice and Procedure has approved for publication for public comment the following proposed amendments to existing rules and forms, as well as one new rule: Appellate Rules 32, 35, 40, and Appendix on Length Limits Bankruptcy Restyled Rules Parts VII to IX, Rules 1007, 4004, 5009, 7001, 9006, and proposed new Rule 8023.1 Official Bankruptcy Form 410A Civil Rule 12 Evidence Rules 611, 613, 801, 804, and 1006 The public comment period is open from August 15, 2022, to February 16, 2023. Notice Regarding New Payment Option for Fees Due to the Court A new option is available for the payment of certain fees, including filing fee installments, searches, certified copies, exemplifications, recordings of hearings, and other fees. By using the Online Payment Form, fees may be paid by debit card, bank account (ACH), or PayPal. If the ACH option is used, please pay close attention to your account information. If we receive a returned item, you will be charged a $53.00 returned item fee. Credit cards are not permitted under this new payment option. The Online Payment Form cannot be used by ECF filers for payments generated in ECF. If you incur a fee through ECF and try to make a payment through the Online Payment Form, your account will be locked out by the ECF system and prevent you from filing anything. The Bankruptcy Threshold Adjustment and Technical Correction Act (BTATC Act) once again increases the total debt threshold (as defined in the Act) for determining the eligibility of a debtor to proceed under subchapter V of chapter 11 to $7,500,000, effective retroactively to cases commenced on or after March 27, 2020 through June 21, 2024 (two years after the date of enactment of the BTATC Act).  The revised forms and other related information can be found on the U.S. Courts website at https://www.uscourts.gov/rules-policies/pending-rules-and-forms-amendments/pending-changes-bankruptcy-forms.

The U.S. Bankruptcy Court for the Western District of Wisconsin has entered General Order 2022-1 Adoption of Interim Bankruptcy Rule.  This General Order adopts the amended Interim Rule 1020 of the Federal Rules of Bankruptcy Procedure in its entirety without change by the judges of the U.S. Bankruptcy Court effective March 27, 2022.  The general order can be found on the Court’s website under Code, Rules & Fees > General Orders.  You can also view the general order here.

The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, July 4, 2022, in observance of Independence Day.  The Court will resume normal operations on Tuesday, July 5, 2022.  CM/ECF will be fully operational and will be accepting electronic filings from registered users.

Currently, debtors' attorneys receive the section 341(a) notice by notice of electronic filing (NEF) with the debtor's redacted Social Security number (SSN) [last four digits], and by U.S. Mail through the Bankruptcy Noticing Center (BNC) with the debtor's full SSN [all nine digits]. Effective July 25, 2022, debtors' attorneys will no longer receive the paper copy of the section 341(a) notice currently sent through the U.S. Mail. Instead, the Bankruptcy Noticing Center (BNC) will send debtors' attorneys an email containing a secure hyperlink to the unredacted section 341 notice in lieu of the paper notice. The BNC will send one summary email per day containing hyperlinks to one or more notices (for example, an attorney filing five cases on the same day should expect to receive one email containing hyperlinks to the notices in all five cases). The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, June 20, 2022, in observance of Juneteenth.  The Court will resume normal operations on Tuesday, June 21, 2022.  CM/ECF will be fully operational and will be accepting electronic filings from registered users.
