The Judicial Conference has approved inflationary adjustments to the bankruptcy court miscellaneous fee schedules effective on December 1, 2020. The inflationary adjustments will increase the fee to file a petition under all chapters and to file a motion to divide a joint case.  Filing fees for the most common chapters will be: Chapter 7, $338; Chapter 11, $1,738; Chapter 12, $278; and Chapter 13, $313.  For a detailed breakdown of all bankruptcy fee changes click here.

The Madison and Eau Claire offices of the U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Wednesday, November 11, 2020, in observance of Veteran's Day. Electronic Filing will be fully operational.

The Madison and Eau Claire offices of the U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, October 12, 2020, in observance of Columbus Day. Electronic Filing will be fully operational.

The U.S. Bankruptcy Court for the Western District of Wisconsin has implemented the Electronic Self-Representation (also known as “eSR”) online tool.   eSR assists pro se debtors in preparing a Chapter 7 bankruptcy petition for later filing with the court after he or she has decided to file bankruptcy without an attorney.  It is not available for attorneys or bankruptcy petition preparers to file a petition and cannot be used for business or corporate bankruptcy filings. The Judicial Conference Advisory Committees on Appellate, Bankruptcy, Civil, and Criminal Rules have proposed amendments to their respective rules, including Bankruptcy Rules 1007, 1020, 2009, 2012, 2015, 3002, 3010, 3011, 3014, 3016, 3017.1, 3017.2, 3018, 3019, 5005, 7004, 8023; and Official Forms 101, 122B, 201, 309E-1, 309E-2, 309F-1, 314, 315, and 425A, and have requested that they be circulated to the bench, bar, and public for comment.  The public comment period closes February 16, 2021.  To view the proposed amendments and the advisory committees' reports explaining the proposed changes, please visit the Rules and Policies webpage on the U.S. Courts website.
