The Bankruptcy Administration Improvement Act (BAIA) was enacted on January 12, 2021 and establishes additional compensation for Trustee’s serving in Chapter 7 Bankruptcy cases. Chapter 7 trustees serving in cases filed on or after January 12, 2021, and through September 30, 2026 (or cases originally filed under chapters 11, 12, or 13 on or after January 12, 2021, and later converted to chapter 7 on or before September 30, 2026) are eligible to receive up to $60 in compensation for each applicable case by certifying they rendered services.   Two new events for Chapter 7 Trustees are available in CM/ECF by which claims for the § 330(e) payments can be made: 1. Trustee Services Rendered Pursuant to § 330(e) Used by Chapter 7 Trustees to certify that they are eligible to receive payment. 2. Withdrawal of Trustee Services Rendered Pursuant to § 330(e) Used by Chapter 7 Trustees to withdraw the Trustee Services Rendered Pursuant to § 330(e). The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on December 24 and 31, 2021, in observance of the Christmas and New Year’s holidays.  CM/ECF will be fully operational and will be accepting electronic filings from registered users.

The following amended rules became effective December 1, 2021: Rule 2005 Apprehension and Removal of Debtor to Compel Attendance for Examination Rule 3007 Objections to Claims Rule 7007.1 Corporate Ownership Statement Rule 9036 Notice and Service by Electronic Transmission   Information about the rule amendments can be found here. The following revised form became effective December 1, 2021: Form 122B Chapter 11 Statement of Your Current Monthly Income   The amended instructions clarify that the form is not to be used by an individual debtor filing under Subchapter V of Chapter 11.   These amendments govern all proceedings commenced on or after December 1, 2021, and all proceedings then pending “insofar as just and practicable.”

The U.S. Bankruptcy Court for the Western District of Wisconsin will be close on Thursday, November 25, 2021, in observance of the Thanksgiving Holiday, as well as Friday, November 26, 2021.  CM/ECF will be fully operational and will be accepting electronic filings from registered users.

The Bankruptcy Court for the Western District of Wisconsin will be close on Thursday, November 11, 2021, in observance of Veterans Day.  CM/ECF will be fully operational and will be accepting electronic filings from registered users.

Alarm and Sprinkler Testing will take place Monday, October 25th from 7:30-9:30 a.m.  The Bankruptcy Clerks office in Eau Clarie will be close during this time.  Please note that the dropbox is available for any filings, the phones will be answered and the Madison’s clerk’s office will open as normal.

The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, October 11, 2021, for the Columbus Day holiday. The Court will resume normal operations on Tuesday, October 12, 2021.
