The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, October 11, 2021, for the Columbus Day holiday. The Court will resume normal operations on Tuesday, October 12, 2021.

The U.S. Bankruptcy Court for the Western District of Wisconsin has posted a sample order that the Court uses in .docx format regarding motions on loan modifications. The Order on Motion Regarding Loan Modification can be viewed and downloaded on the Court’s Forms page.

The Eau Claire office of the U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, September 27, 2021 for building maintenance. The Court will remain open for electronic filing. Normal office operations will resume Tuesday, September 28, 2021.

The U.S. Bankruptcy Court for the Western District of Wisconsin will be closed on Monday, September 6th, 2021, for the Labor Day holiday. The Court will resume normal operations Tuesday, September 7th, 2021.

Effective immediately, the U.S. Trustee for the Western District of Wisconsin will conduct all § 341 Meetings for Chapter 12 and Chapter 13 cases through ZOOM, § 341 Meetings for Chapter 7 cases in Madison and Eau Claire will continue to be held through ZOOM, and all other § 341 Meetings will be by telephone.  Debtors, counsel, creditors, and parties in interest SHOULD NOT APPEAR IN PERSON at any location.   The Court has posted further information and links on the Court’s website, and any further questions or concerns should be directed to the US Trustee’s Office at (608) 264-5522.

The Judicial Conference Committee on Rules of Practice and Procedure has approved publication for public comment of the following proposed amendments to existing rules and forms, as well as several new rules and forms: Appellate Rules 2 and 4; Bankruptcy Restyled Rules for the 3000 to 6000 Series; Rules 3002.1, 3011, and 8003; and new Rule 9038; Official Bankruptcy Forms 101, 309E1, 309E2, and 417A; and new Official Forms 410C13-1N, 410C13-1R, 410C13-10C, 410C13-10NC, and 410C13-10R; Civil Rules 15, 72, and new Rule 87; New Criminal Rule 62; and Evidence Rules 106, 615, and 702. The comment period is open from August 6, 2021 to February 16, 2022. Both the Madison and Eau Claire offices of the U.S. Bankrutcy Court for the Western District of Wisconsin will be closed Monday, July 5, 2021.  Offices will reopen Tuesday, July 6, 2021.

Both the Madison and Eau Claire offices of the U.S. Bankrutcy Court for the Western District of Wisconsin will be closed Friday, June 18, 2021.  Offices will reopen Monday, June 21, 2021.

On December 21, 2020, the United States Trustee Program issued a final rule in accordance with 28 U.S.C. § 589b establishing uniform Chapter 11 Monthly Operating Reports and Post-Confirmation Quarterly Reports by all non-small business chapter 11 debtors.  Debtors who are small businesses or who, in accordance with the CARES Act, elect relief under subchapter V of chapter 11 are not required to use these forms. These new forms must be used for all chapter 11 non-small business debtors report filings on or after June 21, 2021. Until the effective date, however, filers can continue to use their current forms.
