Both the Madison and Eau Claire offices of the U.S. Bankrutcy Court for the Western District of Wisconsin will be closed Monday, May 31, 2021.  Offices will reopen Tuesday, June 1, 2021.

On June 21, 2021, the United States Trustee Program will begin the use of uniform monthly operating reports (MORs) and quarterly post-confirmation reports (PCRs) by all debtors except those who are small businesses or who, in accordance with the CARES Act, elect relief under Subchapter V of Chapter 11. To ensure a smooth transition, the United State Trustee’s Office will host a 1-hour informational session on May 17, 2021, to familiarize filers with the new forms and answer questions about the requirements. The United States Bankruptcy Court for the Western District of Wisconsin has entered General Order 2021-1 regarding amendments to the prior General Orders (2020-3, 2020-5, 2020-6 and 2020-7) Temporarily Suspending “Wet” Signature Requirement. The temporary suspension is extended to July 31, 2021.  The general order can be found on the court’s website under Code, Rules & Fees > General Orders.  You can also view the general order here.

The American Rescue Plan Act of 2021, Pub. L. No. 117-2 (the “ARP”), was enacted on March 11, 2021. It provides relief for qualified individuals to address the impact of COVID-19, including additional recovery rebates and expanded child tax credits. This notice supplements the previous United States Trustee Program (“USTP”) notice provided under the Coronavirus Aid, Relief, and Economic Security Act of 2020, Pub. L. No. 116-136 (the “CARES Act”), and addresses additional questions that may arise under the ARP regarding the treatment of recovery rebates and tax credits in bankruptcy cases filed by individual debtors. The U.S. Bankruptcy for the Western District of Wisconsin continues to work with the Administrative Office of the U.S. Courts to respond to the cybersecurity breach involving SolarWinds Orion software supply chain.  The breach relates to vulnerabilities in the Judiciary’s Case Management/Electronic Case Files system (CM/ECF) that risk compromising highly sensitive documents (HSD) stored on CM/ECF, particularly sealed filings.  Please refer to the U.S. Courts press release issued on January 6, 2021 for complete details. The U.S. Bankruptcy Court for the Western District of Wisconsin has preliminarily concluded that no changes are required to our current CM/ECF filing procedures and protocols arising from these identified vulnerabilities.  The Court does not permit the electronic submission or the storing of any sealed documents or records online.  We will continue to monitor and evaluate ongoing developments regarding this issue for any impact on court systems and CM/ECF users.

Effective as of February 5, 2021, a Supplemental Proof of Claim for CARES Forbearance Claim (Form 4100S) permits an eligible creditor to file a supplemental proof of claim for CARES Act forbearance in a Chapter 13 case. The CARES Act includes a provision that allows borrowers experiencing a financial hardship directly or indirectly due to the COVID-19 pandemic to request a forbearance on their mortgages. This claim can be filed even if the claim’s bar date has passed. This provision will sunset on December 27, 2021. To assist with implementing this new form (Form 4100S), a new event has been created. The event “Supplemental Proof of Claim for CARES Forbearance Claim” is available in the Claim Actions category under the Bankruptcy menu of CM/ECF. *Note: 4100S addresses Section 1001(d) of Title X of the Consolidated Appropriations Act (CAA) (Pub. L. 116-260) which creates a new section 501(f) of the Bankruptcy Code.

The United States Court of Appeals for the Seventh Circuit today announced the appointment of Rachel M. Blise to the office of bankruptcy judge for the Eastern District of Wisconsin. Ms. Blise is planning to take the bench on March 17, 2021. She succeeds Judge Ludwig and will likely sit by designation routinely in the Western District. On December 27, 2020, the Consolidated Appropriations Act (Pub. L. 116-260) was signed into law. This Act includes several bankruptcy related provisions.  Please see the attached document for more information.
